Luris is not a medical device and does not give medical advice. Talk to a doctor or another qualified professional before you start a new exercise programme. You exercise at your own risk, and the numbers in the App are estimates. Stop and seek help if you feel pain, dizziness or shortness of breath. Section 4 explains more.
1. Acceptance of These Terms
These Terms of Use ("Terms") govern your use of the Luris app for iPhone ("Luris" or the "App"). Luris is developed and provided by Cirjan Darius ("we", "us" or "our").
By downloading, installing or using Luris, you agree to these Terms and to Apple's Standard EULA described in section 3. If you do not agree, please do not use the App.
2. Who Can Use Luris
You must be at least 13 years old to use Luris. If you are under the age of majority where you live, you may use Luris only with the permission of a parent or guardian, who should also make or approve any purchase.
Luris has no account of its own. You are responsible for your iPhone and for the Apple Account you use with it, including for Game Center.
3. Your Licence and Apple's Standard EULA
Luris is licensed to you, not sold. Your licence to use the App is Apple's Licensed Application End User License Agreement (the "Standard EULA"), and these Terms add the details that are specific to Luris. If the two conflict, these Terms apply to the extent the law allows, and the terms below in favour of Apple always apply. Your use of the App Store, including any purchase, is also subject to Apple's Media Services Terms and Conditions.
Because you downloaded Luris from the App Store:
- Agreement: these Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
- Licence: you may use the App on Apple-branded devices that you own or control, as permitted by the App Store usage rules.
- Support: we, not Apple, are responsible for maintenance and support of the App. Apple has no obligation to provide any.
- Warranty: if the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Claims: we, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws, including in connection with the App's use of HealthKit.
- Intellectual property: we, not Apple, are responsible for investigating and handling any claim that the App infringes a third party's intellectual property rights.
- Legal compliance: you confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms: you must comply with any applicable third-party terms when using the App, such as your mobile data agreement.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
4. Health and Fitness Disclaimer
4.1 Not medical advice
Luris provides fitness information for general wellbeing and motivation. It is not a medical device. It does not diagnose, treat, cure, monitor or prevent any disease or condition, and nothing in it, including the weekly plan, workouts, goals, streaks and badges, is medical, nutritional or professional coaching advice.
4.2 Talk to a professional first
Consult a doctor or another qualified health professional before you start any exercise programme or change how active you are, particularly if you have a medical condition or an injury, are pregnant or have recently given birth, take medication, or have not exercised for a while. Stop straight away and seek medical help if you feel pain, chest discomfort, dizziness, faintness or shortness of breath.
4.3 Plans and workouts are general
The weekly plan is generated automatically from the answers you give in the App, such as your goal and the days you want to train, and its workouts come from a general exercise library. They do not take your health, fitness level or medical history into account, and they may not suit you. Choose exercises, weights and an intensity that are safe for you, learn the correct technique, and skip anything you are unsure about.
4.4 You exercise at your own risk
You decide whether, how and how much to exercise. To the extent the law allows, you do so at your own risk. This does not limit the liability that section 15 says cannot be limited.
4.5 The numbers are estimates
Steps, distance, floors, energy, exercise minutes, sleep and body measurements come from Apple Health, which receives them from your iPhone, your Apple Watch or other apps and devices. Luris shows what Apple Health provides and cannot check that it is correct. During walks and runs, distance and pace are measured with GPS, whose accuracy depends on your surroundings, your view of the sky and your device. Calories burned during a workout are estimated from the activity, its duration and the body weight in your profile, and where Apple Health has no active energy or exercise minutes, for example without an Apple Watch, Luris estimates them from your steps, floors and weight. None of these figures is exact, and none of them should be used for medical purposes.
5. Staying Safe on Walks and Runs
Luris records walks and runs with your location. It is not a navigation or emergency service. When you use it:
- Stay aware of your surroundings, traffic and other people. Do not look at or use your iPhone while crossing a road or wherever it would not be safe.
- Follow traffic laws and local rules, and use pavements, paths and crossings.
- Choose routes, times and conditions that are safe for you, and let someone know where you are going if you exercise alone.
- Recording continues in the background while a session runs, which uses battery. Keep enough charge to call for help.
- The maps come from Apple and can be incomplete or out of date. They do not show where it is safe or legal to walk or run.
- A route can reveal where you live or where you often go. Share cards hide the start and end of a route by default, so think before you choose to show them.
You are responsible for where, when and how you walk or run.
6. Permissions and Apple Services
Luris uses Apple Health, Location Services, the camera, the photo picker, notifications, Game Center and Sign in with Apple only with your permission, and some features do not work without it. Apple Health, Apple Maps, Game Center and Sign in with Apple are provided by Apple under Apple's own terms. We do not control them and are not responsible for their availability or accuracy. Our Privacy Policy explains how Luris handles the data involved.
7. The Leaderboard
7.1 How it works
The weekly steps leaderboard is optional and runs on Apple's Game Center. If you join, your weekly step total, calculated from your Apple Health steps, appears on the board under your Game Center alias. The board starts over every week. It is for fun: there are no prizes, and a ranking has no monetary value.
7.2 Fair play
To keep the board fair for everyone, you agree not to:
- add steps by hand in Apple Health, or use devices, apps or other means that record steps you did not walk, to raise your score
- tamper with the App, its data or its connection to Game Center, or submit scores in any other way
- use more than one Game Center account to take several places on the board
- exploit a bug or an error to change your ranking
7.3 Names and conduct
Other players see your Game Center alias. You are responsible for it, and it must follow Apple's rules for Game Center. You agree not to use an alias that is offensive, hateful, harassing, sexually explicit or misleading, that impersonates someone else, or that infringes anyone's rights.
7.4 What we may do
If we believe that a score or an alias breaks these Terms, we may, where Game Center allows it, remove the score or the player from the leaderboard, report it to Apple, reset the leaderboard, or stop your use of it. We may also change, pause or stop offering the leaderboard at any time.
7.5 Leaving
You can leave at any time from the leaderboard menu. Luris then stops submitting your score. Game Center does not let apps delete a score that has already been posted, so this week's score stays on the board until the weekly reset.
8. Acceptable Use
You agree not to:
- copy, modify, distribute, sell, rent or sublicense the App
- reverse engineer, decompile or disassemble the App, except where the law allows it
- bypass or tamper with any feature of the App, including any purchase or subscription check
- use the App for any unlawful purpose, or in a way that could damage, disable or impair it
- use share cards or the leaderboard to harass anyone, or to share content you do not have the right to share
9. In-App Purchases and Subscriptions
Luris does not sell anything inside the App at the moment. If Luris offers paid features, such as a subscription, this section applies to them, together with the details shown in the App and on the App Store before you buy.
9.1 Price and what you get
The price, the billing period and what each option includes are shown before you buy, in your local currency. Prices may vary by country and may change. Apple tells you about a price increase for an active subscription before it applies and, where required, asks for your agreement.
9.2 Payment
Payment is charged to your Apple Account at confirmation of purchase, or at the end of a free trial if you started one. Apple processes all payments, and your payment details never reach us.
9.3 Automatic renewal
A subscription renews automatically for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the end of the current period.
9.4 Free trials
If a free trial is offered, its length is shown before you start it. When the trial ends, the subscription starts and you are charged unless you turn off auto-renewal at least 24 hours before the trial ends. Any unused part of a free trial is forfeited when you purchase a subscription.
9.5 Managing and cancelling
You can manage or cancel a subscription at any time in Settings > your name > Subscriptions on your iPhone. Apple's guide is at support.apple.com/en-us/118428. If you cancel, the subscription stays active until the end of the period you have already paid for and then does not renew. Deleting the App does not cancel a subscription.
9.6 Refunds
All payments are processed by Apple, and we cannot issue refunds ourselves. Refunds are handled by Apple under its terms, and you can request one at reportaproblem.apple.com.
9.7 Restoring purchases
If you reinstall Luris or use a new iPhone with the same Apple Account, you can restore an active purchase or subscription in the App.
9.8 Right of withdrawal for EU consumers
If you are a consumer living in the European Union, you generally have the right to withdraw from a contract made at a distance within 14 days, without giving a reason, under Directive 2011/83/EU on consumer rights. For digital content not supplied on a tangible medium, article 16(m) of that Directive allows this right to end once supply has started, but only if you gave your prior express consent to supply starting within the withdrawal period and acknowledged that you would lose the right. Because purchases are made through the App Store, Apple processes withdrawal requests and any resulting refunds under its Media Services Terms and Conditions, at reportaproblem.apple.com. Nothing in these Terms limits your right of withdrawal or any other right you have under mandatory consumer protection law.
10. Your Content
Your workouts, routes, progress photos and everything else you create in Luris remain yours. They are stored on your iPhone, we do not receive them, and we claim no rights in them.
Because your content is stored only on your iPhone, a device backup is the way to protect it. We cannot recover data from a lost, reset or damaged device. You are responsible for anything you choose to share, such as share cards.
11. Intellectual Property
Luris, including its design, code, text, graphics and the Luris name and logo, is protected by copyright, trademark and other intellectual property laws. These Terms do not give you any rights to them other than the licence to use the App.
The exercise descriptions and images in the App's library come from the open-source Free Exercise DB, which its authors released into the public domain under the Unlicense. Apple, Apple Health, Apple Maps, Game Center and App Store are trademarks of Apple Inc.
12. Privacy
Your use of Luris is also governed by our Privacy Policy, which explains how the App handles your data, including your Apple Health data and what goes to Apple for Game Center, Apple Maps and Sign in with Apple.
13. Changes to Luris and Availability
We may update Luris, add, change or remove features, including the leaderboard, and end support for older versions of iOS. We do not promise that the App or any feature will always be available or work without interruption. This does not affect your statutory rights.
14. Disclaimers
To the extent permitted by law, Luris is provided "as is" and "as available". We work to keep the App reliable, but we do not guarantee that it will be free of errors or interruptions, that the figures it shows will be accurate or complete, or that using it will lead to any particular fitness, weight or health result.
This does not affect your statutory rights as a consumer, including the legal guarantee that digital content and services conform to the contract.
15. Limitation of Liability
Nothing in these Terms limits or excludes our liability where the law does not allow it, including liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct, or your mandatory rights as a consumer.
Subject to that, and to the extent permitted by law:
- We are not liable for injury, illness or other harm resulting from exercise or other activity you choose to do, or from relying on the plan, the workouts or the figures in the App.
- We are not liable for accidents, loss or damage that happen during walks and runs you record.
- We are not liable for loss of data that a backup would have prevented.
- We are not liable for losses that were not reasonably foreseeable, or for loss of profit or business, as Luris is intended for personal use.
- Our total liability for all claims relating to Luris is limited to the amount you paid for Luris, including any in-app purchase, in the 12 months before the claim arose.
16. Ending Your Use of Luris
You can stop using Luris at any time by deleting it from your iPhone. Our Privacy Policy explains what deleting the App removes and what stays, such as workouts saved to Apple Health. Deleting the App does not cancel a subscription (section 9.5).
We may suspend or end your right to use Luris, or the leaderboard, if you seriously or repeatedly break these Terms, for example by cheating on the leaderboard. Sections that by their nature should continue, such as sections 4, 14, 15 and 17, continue to apply.
17. Governing Law and Disputes
17.1 Governing law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. If you are a consumer in the European Union, the mandatory consumer protection laws of your country of residence also apply.
17.2 Resolving disputes
If you have a problem with Luris, please contact us first at iosallapps@gmail.com so that we can try to resolve it in good faith. If it is not resolved within 30 days, the dispute may be submitted to the competent courts in Romania or, if you are a consumer in the European Union, to the courts of your place of residence.
18. Changes to These Terms
We may change these Terms. When we do, we will post the new version on this page and update the dates at the top. If a change materially affects you, we will tell you in the App or in the App Store update notes before it takes effect.
If you do not agree to the changed Terms, stop using Luris and cancel any subscription before it renews. Continuing to use the App after the changes take effect means you accept them.
19. Severability and Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
These Terms, together with our Privacy Policy and Apple's Standard EULA, are the entire agreement between you and Cirjan Darius regarding Luris.
